By engaging PichTek (“we”, “us”, “our”) to build or maintain your website, you agree to these terms. If you have questions, email us at hello@pichtek.com before proceeding.
We provide website design, development, hosting, and maintenance services as agreed in your quote. The specific scope, deliverables, and price are confirmed in writing before work begins.
Services are billed at the flat monthly rate stated in your quote. Payment is due on the date agreed. We reserve the right to suspend services if payment is more than 14 days overdue.
You own your website content, domain name, and all materials you provide to us. Upon full payment of all amounts owing, you also own the website design and code we produce for you. There is no lock-in: you may take your website to another provider at any time.
You are responsible for ensuring that any content you provide — text, images, logos — does not infringe third-party rights and complies with applicable law. We reserve the right to refuse to publish content that is unlawful, defamatory, or harmful.
We aim for maximum uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, or events beyond our reasonable control may cause temporary unavailability. We will notify you of planned downtime where possible.
To the maximum extent permitted by applicable law, our total liability for any claim arising from these terms or our services is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect or consequential losses.
Either party may end the arrangement with 30 days written notice. On termination, we will provide you with a copy of your website files within 14 days. No refunds are issued for partial months already billed.
These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes will be subject to the exclusive jurisdiction of the courts located in Texas.
